ESpeed, the electronic trading system, has failed in its attempt to take out a pre-trial injunction on rival firm BrokerTec for alleged patent infringement.

This court ruling has no bearing on the lawsuit which is due to be tried in February 2005, and eSpeed has rejected the claim that its case and the validity of the patent that forms the basis of the lawsuit has been weakened.
